General delivery and payment conditions Leather fashion academy based and with offices in Amsterdam.
Article 1: Application and enrollment
Application is made by submitting either the completed and signed application form or the form on our site.
The date of receipt counts as the registration date.
Registration via both forms are considered binding.
Article 2: Admission and selection
Leather fashion academy determines which students will be admitted. This includes the criterion that the student demonstrably possesses the qualities necessary to follow the course and, for that matter, also meets the requirements that can be set regarding the starting level. If more participants apply for a course than can be placed, in addition to eligibility, the order of application will be held and the remainder will be offered a place on the next course with the same content.
If fewer participants register for a course than the required minimum number, 4 people, Leather fashion academy is entitled to cancel the course without the student being entitled to any compensation. Any course fees already paid will be refunded within two weeks. If the course fee has not yet been paid (in full), Leather fashion academy reserves the right to give priority to other registrants who have paid.
Article 3: Course year, training and short courses
The course year runs from the first full week of September through the last week of June. Vacations and holidays will be announced on the first day of study. Lessons missed by the student can be made up if they are cancelled 24 hours in advance, provided it is organizationally possible. If it is not organizationally possible then the missed classes expire and there is no right to make up. Other courses and workshops take place on the dates indicated via the website.
Article 4: Costs and payment
The price of the trainings, course / workshop is listed on the website. The trainings, courses and workshops are exempt from VAT from August 1, 2019 because we are registered with the CRKBO. Published prices are always subject to change. The course fee can only be paid by bank transfer.
Article 5: Reflection period and cancellation and early termination
There is a 14-day reflection period after registration but no later than the start of the course.
Within 14 days of the registration date, the registration may be withdrawn without further reason, provided that the course has not yet started. Such withdrawal must be in writing. If the tuition is paid within the reflection period then the tuition will be refunded within two weeks.
After this two-week reflection period, the student will owe at least €25 registration fee. In case of cancellation or early termination during the course, there is no right to a refund of the course fee.
Article 6: Force Majeure
Leather fashion academy reserves the right to replace the original instructor. In case of illness, the supervisor will find replacement dates for the missed classes within the respective course year. Leather fashion academy reserves the right to reschedule a course/training in the event of insufficient enrollment. With what is said in the above paragraph, Leather fashion academy is deemed to have sufficiently fulfilled its obligations towards the student and therefore the student is not entitled to further compensation.
Article 7: Interest and costs
If the course fee due is not paid, the student will first receive a payment reminder. Should payment not occur, a reminder will be sent and the amount due will be increased by at least €12.50 in administrative costs. If the amount mentioned in the above paragraph has not been credited to Leather fashion academy's account within 10 days of the date of the reminder, the student will be in default and Leather fashion academy may pass the claim to a collection agency. Collection costs are the responsibility of the student. The student must also pay legal interest from the date the student is in default.
Article 8: Dissolution
Leather fashion academy is authorized to consider the agreement dissolved in whole or in part with immediate effect, without further notice of default and without prior judicial intervention, if the other party fails to fulfill any obligation under the agreement.
Article 9: Liability
Employees of Leather fashion academy provide training and advice in good conscience. Leather fashion academy accepts no liability for any adverse consequences that may occur as a result, subject to its responsibility to the law.
Article 10: Complaint procedure
Leather fashion academy values the satisfaction of our participants. Our training will make every effort to provide you with the best possible service. Still, you may be dissatisfied with some aspect of our service. The following describes what you can do then. Complaints should be submitted in writing or by e-mail to Leather fashion academy, info@leatherfashionacademy.nl Complaints will be handled within 4 weeks. If a longer time is needed to investigate, the participant will be notified within 4 weeks, explaining the delay; in addition, an indication will be given of when it is expected to be able to give a definite answer.
Within 14 days, you will receive a written response outlining further processing. Complaints are handled confidentially and complaint files are kept for 12 months.
Article 11: Independent third party
If you are not satisfied with our response, you may also contact Mr. Peter Prommel, complaint handler, supervision and E-coaching LVSC reg. No. 14444 . https://www.lvsc.eu/users/peter-prommel with mailing address; p.prommel@me.com The judgment of the appellate body / complaint handler is binding on Leather fashion academy; any consequences will be handled promptly by Leather fashion academy.
Article 12: Personal data and confidentiality
12.1 The name, address and e-mail details of the course participant/student will be included in the Leather fashion academy address database and will be used for the organization of the courses and to keep the course participant/student informed of the courses offered by Leather fashion academy. Data will be provided to third parties only when strictly necessary for the proper delivery of education and with the consent of the student/student.
12.2 Anyone who is involved from Leather fashion academy in the implementation of a training course and in doing so gets access to information of which he/she knows or should reasonably suspect the confidential nature, is obliged to keep it confidential.
12.3 Both parties are obliged to keep confidential all confidential information obtained from each other or from other sources in the context of their agreement. Information is considered confidential if it has been communicated by the other party or results from the nature of the information.
Article 13 - Copyrights
13.1 The copyrights to the course material produced by Leather fashion academy and provided to the course participant/student belong to Leather fashion academy. It is therefore not permitted to reproduce and/or publish the material by photocopy or any other means, without the prior written consent of the rightful owner, namely Leather fashion academy.
13.2 The visual material produced during the lessons of the training/course for the benefit of the website, social media and promotional material is the property of Leather fashion academy and may be used for these purposes. A request not to use this material must be made verbally or in writing at the beginning of the course/training.
13.3 No rights can be derived from any typing or typesetting errors regarding prices, price changes and changes regarding the content of the courses mentioned on the website or other publications of the Leather fashion academy.
Article 14 - Amendment of the General Conditions
14.1 Unless otherwise agreed in writing, the General Conditions may be amended by Leather fashion academy. The amended terms and conditions will be published on the Leather fashion academy website at least fourteen (14) calendar days before they take effect.
The student/student will be notified digitally of any change to the terms and conditions.
